About These Terms

These terms are an agreement between you and Lukemani ("we", "us"), the operator of fogpanther.com. They apply when you use this website, create an account or buy a license in our store. By doing so, you agree to them. The Fog Panther software is governed by the license agreement that comes with it; these terms do not cover the software.

Your Account

• You must give accurate information, including a valid email address.
• You are responsible for keeping your password secure and for activity under your account. Tell us straight away if you think someone else has accessed it.
• You must be old enough to enter into a binding contract where you live, or have the permission of a parent or guardian.

Purchases and Payment

Prices are set in US dollars on our pricing page; at checkout, Stripe may show and charge the equivalent in your local currency. A purchase is a one-time payment for a Fog Panther license key; there is no subscription. Payments are processed by Stripe under its own terms. Once payment is confirmed, we email your license key and make it available in your account. We may change our prices at any time, but a change never affects a purchase you have already made. We may refuse or cancel an order we reasonably believe is fraudulent.

Refunds

Because Fog Panther can be tried for free before you buy, all purchases are final and we do not offer refunds, except where the law requires us to. Nothing in these terms affects your statutory rights as a consumer.

Acceptable Use

Do not use this website or store for anything illegal or fraudulent, try to access accounts or systems that are not yours, get around our security or rate limits, or place an unreasonable load on the site with bots or other automated tools.

Intellectual Property

This website and its content, and the Fog Panther name and logo, belong to Lukemani and are protected by intellectual property laws. You may not copy or reuse them except as the law allows.

Suspension and Closure

We may suspend or close an account that breaks these terms or is used fraudulently. You can ask us to close your account at any time.

Disclaimer and Limitation of Liability

To the maximum extent permitted by law, this website and the store are provided "as is" and "as available", without warranty of any kind, express or implied. Lukemani is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data, arising out of or in connection with your use of this website, your account or a purchase, and our total liability for a purchase shall not exceed the amount you paid for it. We are not responsible for the content or practices of other sites we link to. Nothing in these terms limits any liability that cannot be limited under applicable law.

Indemnification

To the maximum extent permitted by law, you agree to cover Lukemani's losses and reasonable costs from claims caused by your misuse of this website or your account, or your breach of these terms. If you are a consumer, this applies only where the claim results from your intentional or negligent conduct, and only as far as your local consumer law allows.

Changes to These Terms

We may update these terms from time to time. We will post the updated terms on this page with a revised "last updated" date. The terms in effect when you make a purchase apply to that purchase. Continuing to use the website after a change means you accept the updated terms.
